1. Acceptance of Terms

By accessing or using Plugin Library ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We may update these Terms from time to time, and your continued use of the Service after such updates constitutes acceptance of the revised Terms.

2. Description of Service

Plugin Library is a subscription-based web application that helps audio professionals and enthusiasts manage their collection of audio plugins. The Service includes:

  • Plugin library organization and tracking
  • Search and filtering capabilities
  • Plugin recommendations based on your library
  • Session context for project-specific recommendations
  • Screenshot import for plugin detection

3. Account Registration and Security

3.1 Account Creation

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Use a strong, unique password
  • Not share your account credentials with any third party
  • Notify us immediately of any unauthorized use of your account
  • Log out of your account at the end of each session when using shared devices

4. Subscription and Payments

4.1 Free Tier

Plugin Library offers a free tier with limited features. The free tier may be subject to usage limits that we may modify from time to time.

4.2 Paid Subscriptions

Paid subscriptions are billed on a recurring basis (monthly or annually, depending on your selection). By subscribing, you authorize us to charge your payment method at the beginning of each billing cycle until you cancel your subscription.

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. We do not provide refunds for partial billing periods unless required by applicable law.

4.4 Price Changes

We reserve the right to change subscription prices. We will provide you with at least 30 days' notice before any price increase takes effect on your account.

5. User Responsibilities

5.1 Accurate Information

You agree to provide accurate information about the plugins in your library. While we understand that plugin ownership records may not be perfect, you should not intentionally misrepresent your plugin collection.

5.2 Lawful Use

You agree to use the Service only for lawful purposes. You may not use the Service to:

  • Track or manage pirated software
  • Infringe upon the intellectual property rights of plugin developers
  • Violate any applicable laws or regulations
  • Harass, abuse, or harm others

5.3 Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference.

6. Recommendation Features Limitations and Disclaimers

6.1 Recommendation Nature

The recommendation features are provided as suggestions only. The assistant:

  • Recommends plugins from your existing library based on your described needs
  • May not always provide optimal recommendations for every situation
  • Is not a substitute for professional audio engineering judgment
  • May occasionally provide inaccurate or incomplete information

6.2 No Guarantee of Results

We do not guarantee that following recommendations will achieve any particular audio result. Your creative decisions remain your own responsibility.

6.3 AI Capabilities

The AI assistant is designed to help you find the right plugin for your project from your library. It is not designed to teach audio engineering concepts, provide detailed technical support for specific plugins, or make decisions about your creative work.

7. Affiliate Links and Disclosures

7.1 Affiliate Relationships

Plugin Library may include links to third-party retailers where you can purchase plugins. Some of these links may be affiliate links, meaning we may earn a commission if you make a purchase through them.

7.2 No Endorsement

The inclusion of affiliate links does not constitute an endorsement of any particular retailer or product. We strive to provide accurate information, but prices, availability, and product details may change without notice.

7.3 Transparency

Affiliate links will be clearly identified where required by law. Our recommendations are based on your library and needs, not on affiliate relationships.

8. Intellectual Property

8.1 Plugin Ownership

Plugin Library does not own or license any audio plugins. We provide a tool to help you organize information about plugins you own. All plugin names, logos, and trademarks are the property of their respective owners.

8.2 Our Content

The Service, including its design, features, and original content, is owned by Plugin Library and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without our express written permission.

8.3 Your Content

You retain ownership of any content you create within the Service (such as notes, custom tags, and session descriptions). By using the Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

9. Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and share your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Account Termination

10.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination, your data will be handled according to our Privacy Policy.

10.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We will retain your data for a reasonable period to allow you to export it, after which it will be deleted in accordance with our Privacy Policy.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Any defects will be corrected
  • The Service or its servers are free of viruses or harmful components
  • The results of using the Service will meet your requirements

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PLUGIN LIBRARY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or alteration of your data
  • Any third-party conduct on the Service
  • Any other matter relating to the Service

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold harmless Plugin Library and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit to the Service

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

15. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Plugin Library regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

16.3 No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

16.4 Assignment

You may not assign your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.
